Formless Inc., doing business as Vidzap, respects the intellectual property rights of others and expects our users to do the same. This policy explains how to report infringement, how to challenge a removal, and what happens to accounts that keep infringing.
1. Reporting copyright infringement (DMCA notice)
If you believe material on Vidzap infringes a copyright you own or are authorized to act for, send a written notice to our designated agent at dmca@vidzap.ai.
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed — or, if multiple works are covered by a single notice, a representative list of them.
- Identification of the material you claim is infringing, with enough detail for us to locate it — a direct URL, a share link, an account name and a description, or an asset identifier. “Somewhere on your site” is not enough for us to act on.
- Your contact information: name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf.
A note on generated content. Vidzap produces synthetic material. Before submitting a notice, please consider whether the material genuinely reproduces protected expression from your work, rather than resembling it in style, subject or genre. Copyright does not protect a style, an idea, a technique or a general aesthetic.
Misrepresentations carry liability. Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing can make you liable for damages, including costs and legal fees.
2. Designated agent
Notices should be sent to:
DMCA Designated Agent
Formless Inc. (DBA Vidzap)
18117 Biscayne Blvd, Suite #2339
Miami, FL 33160
Email: dmca@vidzap.ai
Email is the fastest route and is the one we monitor most closely.
3. What we do when we receive a notice
On receipt of a notice that substantially complies with the requirements above, we will:
- promptly remove or disable access to the identified material;
- notify the user who posted or generated it, and pass on a copy of the notice, including the identifying information it contains;
- inform them of their right to submit a counter-notification; and
- record a strike against the account under section 5.
If a notice is incomplete, we will tell you what is missing. We may decline to act on a notice that remains non-compliant.
4. Counter-notification
If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notification to dmca@vidzap.ai containing:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the US federal district court for the district where your address is located (or, if you are outside the US, the Northern District of California), and that you will accept service of process from the person who submitted the original notice or their agent.
If we receive a valid counter-notification, we will forward it to the original complainant. Unless they notify us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.
Misrepresentations in a counter-notification carry the same § 512(f) liability as misrepresentations in a notice.
5. Repeat-infringer policy
We terminate the accounts of repeat infringers in appropriate circumstances.
- A strike is recorded when we remove material in response to a valid notice.
- A strike is withdrawn if the material is restored following a counter-notification, if the complainant retracts the notice, or if we determine on review that the notice was invalid.
- Three strikes results in account termination. Unused credits are forfeited.
- We may terminate an account sooner where the infringement is flagrant, commercial-scale or accompanied by other breaches of our Terms of Service.
- Terminated users may not open a new account. Doing so is itself a breach.
You can ask us to review a strike by writing to dmca@vidzap.ai with your reasoning.
6. Trademark complaints
If you believe content on Vidzap infringes your trademark — for example, generated creative that reproduces your mark, logo or trade dress in a way likely to confuse consumers — email dmca@vidzap.ai with:
- The mark at issue, its registration number and jurisdiction (or the basis of your common-law rights).
- The goods or services it covers.
- Identification of the content you are complaining about, with enough detail for us to locate it.
- An explanation of why the use is likely to cause confusion, dilution or another form of infringement.
- Your contact details and a statement of good-faith belief that the use is unauthorised.
Trademark complaints do not have the DMCA’s statutory notice-and-counter-notice framework. We review them on their merits and may consult the user before acting. Descriptive, comparative, nominative and other fair uses of a mark are not infringement, and we will not remove content solely because a mark appears in it.
7. AI-generated outputs
Vidzap generates new material from your inputs and from third-party models. We do not warrant that any Output is original or free of third-party rights, and section 4 of our Terms of Service says so plainly.
The processes in this policy apply to Outputs exactly as they apply to uploaded material. If an Output reproduces protected expression from your work, tell us and we will act on it.
Because the law on AI and copyright is actively developing across jurisdictions, we assess these complaints case by case and may seek additional information from either side.
8. Abuse of this process
Takedown processes get abused — to silence competitors, to remove criticism, or as a form of harassment. We may decline to act on notices that are:
- submitted repeatedly for material we have already determined is non-infringing;
- fraudulent, or sent by someone with no rights in the work claimed;
- transparently intended to harass a user or suppress lawful expression; or
- so lacking in specificity that acting on them would require us to guess.
Persistent abuse may result in us refusing future notices from the sender and, where warranted, referring the matter to the affected user.
